摘要：

The trade mark “HOTTOREMON” (“HOTTO” in Hiragana meaning “hot” and “REMON” in Katakana meaning “lemon”) lacks distinctiveness for “lemon-added soft drink/lemon-added fruit juice”, as it merely describes the relevant good’s quality or raw material (Sec. 3(1)(iii) Trade Mark Act) and has not acquired distinctiveness through use, either (Sec. 3(2) Trade Mark Act). It thus cannot be registered.
