摘要
Finding at European level the best legal instrument for workers' financial participation in companies to make possible their access to social capital is today a desirable objective within the sector of social innovation in the field of employment. In addition, it is an especially necessary objective to articulate the business succession of SMEs, as well as family-owned companies, especially important at times such as the current generational change. European projects such as SI-Drive have revealed from the economy, sociology and organizational psychology that this issue (workplace innovation) has a key potential, among other things, to help organizations create value and conditions in parallel necessary to enable employees to be involved in business life. The present work aims to analyze in the light of the Private Law the appropriate legal formulas (protected funds specially) that allow the employees participation through the legal recognition of the ownership of the capital.
