Practical Considerations for Trade Remedies Disputes at the National and World Trade Organization Levels Part 3: Considerations for Challenge of a Trade Remedy and for Participation in World Trade Organization Consultations
In this article, the author presents certain considerations that an exporting country should take into account for challenging a trade remedy measure and related investigation before the dispute settlement mechanism of the World Trade Organization (WTO). Assuming that the exporting country, or 'potential complainant', has determined the viability of its challenge, the article also provides practical considerations to face the first stage of the WTO dispute settlement process - consultations - in this case, from the perspective of both complainant and respondent.
