摘要
Paraphrasing the question Boaventura de Sousa Santos adopts as title of the article "Can Law be Emancipatory?", this essay proposes readdressing the text mentioned, based, mainly, in another work from de same author named "Beyond Abyssal Thinking: from Global Lines to Ecologies of Knowledges". It transposes the conclusions achieved into a dialogue with his concept of "transformer constitutionalism" to question if there could be space in Brazilian Criminal Justice to emancipation. We respond it positively based on some judges counter-hegemonic posture while analyzing criminal issues in the light of 1988 Federal Constitution.
