Reflections on public-private partnerships in Egypt: practical and legal challenges

This article addresses an increasingly important topic in the field of law and finance, namely public-private partnerships (PPPs). The article examines the practical and legal challenges facing PPPs within the Egyptian market and scrupulously analyses such challenges in light of the current prevailing global trends and standards of project financing. Amongst the challenges scrutinised are: procedural issues, project permits, regulatory framework, bankability and risk allocation, availability payments and termination compensation, direct agreements, and applicable law and dispute resolution. The article provides a lucid and cogent understanding of the PPP market in Egypt, from both legal and practical perspectives, in light of the contemporary investment climate.
