The legal measures of control of COVID-19 (isolation, quarantine, and compulsory health treatment) and its proportionality

摘要
The present article inquires some sanitary measures provided in Brazilian statute for the control of COVID-19 isolation, quarantine, and compulsory health treatment, for the purpose to examine if they are unconstitutional. The text considers them as limitations to fundamental rights, which were carried out in order to protect the fundamental right to health, especially in its collective dimension of public health. Identifying a normative conflict between constitutional principles, the proportionality norm is used to structure the balancing. It concludes that these measures are proportional.
