THE THREAT IN THE EUROPEAN CONTRACT LAW: A REFLECTION ON THE INFLUENCE OF CLASSICAL ROMAN LAW ON SOME ASPECTS OF ITS LEGAL CONFIGURATION

with this study I try to approach, in general terms, the legal configuration of the threat, according to the main proposals of harmonization of European contract law, so that it can be qualified as a defect of consent and, therefore, make possible the annulment of the contract; and this, with the ultimate aim of reflecting on the aspects of its legal formulation that, at first sight, seem to be based on Roman foundations, as well as on the novelties that are separated from the Romanist tradition.
