摘要
Marketization reform of Energy price mechanism is a general trend. But there are still some controversial problems in these two issues which are how to achieve marketization and whether the Marketization of Energy Prices needs the legal regulation of anti-monopoly law. The paper employs the research methods of legal economics and empirical analysis, and puts forward that in order to meet the requirements of the formation of market prices, it needs not only to develop the private economy and introduce the market competition mechanism, but also the legal regulation of anti-monopoly law because the anti-price monopoly law is applicable in this field. The marketization of energy prices should rely on the legal regulation of agreement monopoly. To sum up, the economic mechanisms and legal mechanisms should be complementary to each other and play the role together. Only through this, refined oil pricing mechanism can be really formed in accordance with market competition in china and promote the healthy development of the national economy.
