Human rights and coloniality: after 70 years of the universal declaration

摘要
From a decolonial option, this paper goes back to the epistemic-ontological construction of the subject of rights that was iniciated facing the colonial invasion of Abya Yala in the 16th century and the simultaneous and neccesary production of the "indian" and the "negro", that was later consolidated with the enlightment postulations and the 18th-century declarations of rights. From the categories of colonial doubt and sameness, with this long-range perspective, it is disputed the universality of the hegemonic-colonial history of human-rights, locating the Universal Declaration of Human Rights (UDHR) as a provincial event presented as universal, showing the link of the implicit human rights' conception in the UDHR with the modernity-coloniality project.
