Human Right to Peace as a Globalization Outcome

The protection and implementation of human rights worldwide was linked to the aim of securing peace in the Charter of the UN and in the International Bill of Human Rights. Nevertheless, the conversion of peace into a legal category of human right has received definite outlines during nearly the two last decades and it culminates CO date with an official codification process undertaken since 2010 by the UN Human Rights Council and with the expectation of the approval in 2015 of the Universal Declaration on the Human Right to Peace by the UN General Assembly. I will consider three aspects of such juridification of peace that reflect some strengths and ambivalences of globalization from which it results, one concerning the very codification process, the other focusing the status of the human right to peace and some of its political implications. First, the most forward-looking advocates of the recognition of the human right to peace were drawn from civil society organizations and non-stare actors initiatives, which were crucial for starting up and even running the official codification process. Second, the series of private and official draft declarations confirm that the right to peace belongs CO the third-generation human rights and rests on a comprehensive conception of positive peace that interconnects the whole of human rights. Finally, the right to peace involves a demanding political dimension by making the states the main duty-holders both individually and as a collective of actors and by requiring the promotion of social justice at the global level.
