摘要
The Constitution is the fundamental law of a State, constituted by all legal rules that regulate the social relationship that are fundamental and essential for establishing, maintaining and exercising political power of the people. In all constitutional systems, the constitution is imposed as a fundamental law for the organization and function of the state. The Romanian Constitution had a decisive role in the legal framework to exercise the power and the institutionalization and the mechanisms of governance. The legitimate Constitution through rules and principles made radical changes to the Romanian political system. In general speaking the Constitution marked the finalization of the general transition of society from the totalitarian state to the rule of law also by voting the Constitution in a national referendum, it was a confirmation of the decision of the Romanian people and national sovereignty to establish a new democracy of the state and its devotion for a constitutional democracy.
