The Process of Filiation from the Techniques of Assisted Human Reproduction in Homoparental Couples

摘要
Parentage is a fundamental link to establish the legal relationship between parents and children and the effects that arise from it. Likewise, assisted human reproduction techniques are means that homoparental couples resort to more and more every day. In this sense, the intention of the research was to outline a legal critical analysis document determining the parameters for establishing the filiation of homoparental couples with the children from assisted reproduction techniques. A qualitative-quantitative mixed modality was proposed, with statistical data and subjective reflections. The results showed that homoparental couples resort to assisted reproduction techniques, but when it comes to legally establishing parental ties, it is not established in the norm. Therefore, it was concluded that a mixed figure that links the biological scope and link as well as the legal link, because there would be the biological father and the father that results in links to the child through legal attributions, could be a form of establish a mechanism for affiliation.
