THE RIGHT TO KNOW THEIR ORIGINS: A MANIFESTATION OF THE BEST INTERESTS OF THE MINOR

In the present work, the indeterminate legal concept of the best interest of the minor is analyzed from a global perspective and a tangible relationship is established between the right of the child to know his biological origins and this interest, which enjoys a genuine and uncontroversial character prevalent in all the procedures (administrative or judicial) in which he attends. Considering arguments from different doctrinal positions, it is concluded that this right of the minor is indiscernible from his own superior interest, being the cornerstone that calls into question the application of certain practices in Spain; among others, and very especially, that of the so-called "wombs for rent", today illegal in our country, in coherence with the interests of minors.
