世界贸易组织谈判功能重振中的“联合声明倡议”开放式新诸边模式

摘要：

近年来基于“联合声明倡议”方式进行的开放式新诸边模式作为传统多边谈判的必要补充，在法律和政治层面引发诸多讨论，成为世界贸易组织改革中的重大争议问题。开放式诸边模式并未违反《成立世界贸易组织的马拉喀什协定》,在一般国际法上亦具有合法性。此类谈判成果若能成为关键多数协定，则可基于最惠国待遇原则将协定利益扩及所有世界贸易组织成员。我国是开放式诸边谈判的重要参与方，在坚持多边主渠道的同时，可针对开放式诸边谈判的议题选择、启动方式以及成果走向等重大问题提出注重发展导向的系统性建议，以期重振世界贸易组织的谈判功能。
