THE PUBLIC PROSECUTOR'S OFFICE BETWEEN LAW AND POLITICS: TOOLS FOR ANALYSIS AND EVALUATION

The purpose of this text is to present some basic and fundamental concepts related to the Public Prosecutor's Office and its role within the institutional system. The purpose of this study is to provide a comprehensive analysis of the Public Prosecutor's Office as an institution, with a focus on identifying its fundamental characteristics. The ensuing discourse is founded upon meticulous bibliographical research, and the written exposition is structured in two sections. Firstly, the fundamental concepts of public interest, extraordinary legitimacy, diffuse and collective rights will be presented for discussion, in order to facilitate debate on the trajectory and competence of the Public Prosecutor's Office from two viewpoints. Secondly, categories of analysis will be presented for consideration. These categories are intended to facilitate an institutional understanding of the Public Prosecutor's Office. They include risk typologies, the constitutionalism of optimisation, and notions such as distrust and precaution. The final section of the analysis examines the relationship between institutional capacities and dynamic effects.
