A COMPARATIVE LAW FOR THE "COMMON HUMANITY"

The writing contains some critical reflections on the comparative legal method. The aim is to offer an analytical perspective based on the waiver of the imperialistic and deceivingly universalistic mentality which a large portion of comparative law works in the West is affected by. After defining in what sense western legal tradition represents a modern bed of Procustes, it deals with the toolbox designed for the law scholars interested in "de-colonizing" or "de-imperializing" comparative law, focusing on the ratings published by Freedom House, perfect epitome of how liberalism really works at global level, that is by restricting sacred spaces of liberty. Finally, it examines the lack of democracy underlying this way to understand the relationships among peoples of the world, the so-called Herrenvok Democracy, revealing its hypocrisy.
