Regulation of Afro-Colombian Traditional Midwifery in the Pacific: between exclusion and inclusion

摘要
Through the Ministry of Culture issued Resolution 1077 of 2017, Colombia declared Afro-Pacific midwifery as an intangible cultural heritage of the nation; however, it still does not recognize it as a medical practice within its health system. Given this situation, this article presents a review of the regulations issued following the Constitutions of 1886 and 1991 that affect this knowledge to determine whether the legal treatment granted, not only as a cultural expression but also as a medical practice, aligns with the principles of ethnic diversity, pluralism, and multiculturalism. To achieve it was employed a qualitative-descriptive methodological design using the deductive method to analyze legal information, finding that despite the current constitutional openness and inclusion, the legal exclusion of Afro-Colombian midwifery and the lack of protection for Afro-descendant midwives within the official health system persist.
