Constitutionality of the International Law of Regional Social Security

The normative recognition that is given to social security through the Latin American letters contributes to the justiciability of this human right. However, there are not a lot of studies about the impact of this constitutional recognition for the development of regional International Social Security Law (DISS), which is the legal guarantee of the human right to social security for migrants. In this sense, this article presents a brief study of the regional DISS and analyzes the constitutional framework of the human right to social security in some examples from Latin America, highlighting the important role of the Inter-American Court of Human Rights, with the aim of verifying that The theory emanating from the neo-constitutional socialism provides new perspectives to the International Law of regional Social Security.
