This article highlights the importance of theoretical formulation of the acculturate process elaborated by Norbert Elias to properly comprehend the concept of fundamental rights. As a matter of fact, it is a form of envision those rights which permits overcoming the lagged dichotomy established between jus-naturalism and logical positivism.
