How to overcome the strength of political parties in the Constitutional Court: The reform of article 159 of the Spanish Constitution

The political positioning that the Spanish Constitutional Court has experienced during the last few years has caused a devaluation of its credit and prestige. This research considers the possibility of reforming article 159 of the Spanish Constitution and explores some reforms that, reaffirming the Constitutional model established by the Spanish Constitution of 1978, would not only avoid appointments by political parties but also make the Court a more democratic and a less political institution, aiming to overcome the strength of political parties and to strength a key institution of our constitutional system.
