摘要
This article is extracted from the Monograph presented to the UniEvangelica Course of Work, as a partial requirement to obtain a bachelor's degree in Law from Danielle Verissimo da Silva, under the guidance of the Master Professor Katia Rubia Leite. The bibliographic study of outsourcing Applied to the Brazilian public sector addresses the historical evolution of labor relations and capitalism to contextualize the theme and explain the objectives of its achievement, in, the implementation of neoliberal ideas as a way to achieve the reduction of bureaucracy, efficiency and economics in the execution Services through a tendering procedure. The research travels through constitutional and administrative law through its principles and in infra constitutional terms, for understanding the institute, one must seek its normative base mainly in Laws n. 8,666/93, in Precedence n. 331/2011 of the Superior Labor Court, in the normative instructions n. 02/2008 and n. 3/2009, of the Ministry of Planning, Budget and Management, and Decree n. 200/67. Finally, the research will highlight the doctrinal divergences regarding the limits of outsourcing as a medium-activity and end-activity, which will lead to the approach of the Social Organizations in health and education, as a means of effecting outsourcing.
