THE PROBLEMS OF IMPROVEMENT OF THE LEGISLATION ON AGRICULTURAL CREDIT COOPERATIVES IN THE REPUBLIC OF AZERBAIJAN IN RUSSIAN FEDERATION

The article is devoted to the problems of improvement of the legislation on agricultural credit cooperatives. The author notes that the lawmakers and lawyers have ignored the model of the agricultural loan or credit and saving cooperative which had existed before the revolution and during the period of the new economic policy. The article emphasizes that the measures on maintaining the agricultural credit cooperatives didn't result in adoption of certain decisions which would enable the development of this trend in the agricultural consumers' cooperatives in the Republic of Azerbaijan and this is also true of the Russian Federation. The analysis of the existing legislation on the agricultural credit cooperatives in the article enables the author to conclude that Russian Federation lacks a comprehensive law on the agricultural credit cooperatives, and the Republic of Azerbaijan is undertaking the first steps to creatingn the legal basis of the agricultural cooperatives, the agricultural credit cooperatives including. The author, arguing with Russian experts in the field of agricultural credit cooperatives, remarks that the researchers in the field of agricultural credit cooperatives, considering the existing agricultural credit cooperatives within the current agricultural credit cooperative law, actually equal the agricultural credit cooperatives to credit consumers' cooperatives of the citizens (loan or credit unions) which differ by the purpose of establishment and the round of duties. The loan or credit cooperative of the citizens is to meet the needs of its members in the consumers' loan, whereas the agricultural credit cooperative is established, first of all, to provide the economies of its members with the available industrial loan, which is one of the principles of the agricultural credit cooperatives creation, as developed by F.V. Raiffeisen. The author sets forth the proposals to broaden the authorities of the agricultural credit cooperatives on the basis of this country's experience of the credit cooperatives functioning, provides the classification of agricultural credit cooperatives, on the assumption of the principle of their mutual fund and non-mutual fund establishment, puts forward the proposals on united construction of agricultural credit cooperatives.
