摘要
Globalization is currently demanding the uniformization of the governing rules of international trade contracts. Uniformization represents a constant concern of major international fora, thus materialized in various conventions. Some of these conventions include the Hague Convention (1964), the Vienna Convention and the Rome Convention (1980) and the Latin American Specialized Private Law Conventions and the community rules. Moreover, these sets of norms also is applicable to the United Nations Commission for International Trade and the World Trade Organization, and also the International Institute for the Unification of Private Law with the objective of establishing homogeneity of the various contractual provisions and also aiming at the common legal terminology. The uniformization process shall be based on basic principles such as the freedom of contract, the freedom of format, bona fide and lex mercatoria.
