There has been a steady increase in trust litigation in the British Virgin Islands (BVI) underpinned by the growth of litigation teams in offshore firms in Hong Kong and in Europe 1. This is perhaps unsurprising given the popularity of the BVI with foreign investors, both for incorporating holding companies and for creating trust structures for tax efficient succession planning. This article provides a round-up of BVI trust and probate litigation over the last 12 months.
