The article examines the legal status of a suspect or accused in criminal proceedings. It is noted that in the present conditions the implementation of legal safeguards for protection from prosecution, particularly in pre-trial stages of the criminal process is difficult. Primarily this is due to a weak judicial control, as well as the lack of activity on the part of the legal community in upholding the position of principal in the criminal case. It is proposed under the control of the court put a series of procedural decisions involving restrictions on the personal integrity of the suspect or accused.
