摘要：
The public housing policies that have applied in Spain have caused the actual crisis on this issue. Dwellings have become a financial investment (a merchandise to sell or to buy), abandoning in this way their basic human right sense. This paper has three objectives: first to show the vision of different institutions in Spain and Catalonia regarding the house sector; secondly, to give an overview of the housing legislation in Spain and in Catalonia; and thirdly, to came into the necessity of a new public policy in which the right to housing and the social function of the property concepts are applied, with other proposals of public policy and incentives in the fiscal scope.
