摘要
In Ecuador, the Organic Law of Human Support was promulgated to seek the sustainability of employment. One of the provisions of the aforementioned normative body exposes the faculty of employers to terminate the work contract by fortuitous case or force majeure. The crisis generated by the pandemic of Covid-19 resulted in the termination of the employment relationship of a large number of workers, violating the rights recognized by constitutional bodies. The objective of this research is to determine the incidence of the termination of the employment relationship by fortuitous case or force majeure in the right to compensation in times of pandemic. The methodology used is qualitative research to be developed within the social sciences. As the main result, the erroneous application of the legal figure of the fortuitous case or force majeure for the termination of the employment relationship was determined, and therefore the violation of the rights, principles and guarantees that are granted by law to workers.
