The historical aspect and history of the transfer of the penitentiary system from the structure of the MIA of Russia to the Ministry of Justice of the Russian Federation

The research aims to make an attempt to identify the most significant factors underlying the final decision through the prism of analyzing the causal complex of decision-making on the transfer of the criminal Executive system from the jurisdiction of some bodies to the composition of others. The author comes to the conclusion that the consolidation of the penitentiary system in the justice system occurs in conditions when there is a need to liberalize the criminal policy of the state and Vice versa-the transfer of the criminal Executive system to the internal Affairs bodies is preceded by a deterioration of the criminal situation in the country, its dynamics and structure, tightening of the criminal policy, its punitive component.
