Research on Legal Issues of the Realization of the Priority Right to Be Repaid on the Construction Project Fund

To solve the problems of project payment in arrears in construction industry, the article 286 of Contract Law (1999) stipulated the contractor's priority for construction fund. with the emergence and development of social law, the law has gradually inclined to the vulnerable groups that need special protection. It is obvious that the article 286 of the Contract Law has provided an interpretation of the priority right to be repaid on the project fund for protecting the vulnerable groups. However, due to the deficiencies of the relevant law, the realization of the right is not ideal, based on analysis the nature of the said right, it put forward some countermeasures and suggestions, in order to provide a reference for solving the realization of the priority right to be repaid on project fund. Therefore, this paper starts with defining the nature of right for the priority right to be repaid on the project funds, and then analyses encountered obstructive factors during the process of realization. Finally, it put forwards some countermeasures in order to protect the right of contractors and peasant workers.
