INTERFERENCES BETWEEN REFERENCES ON PRELIMINARY RULING AS PROVIDED BY ARTICLE 267 ξ 2 OF TFEU, WITH VARIOUS ACTIONS BROUGHT BEFORE THE COURT OF JUSTICE OF THE EUROPEAN UNION

The present paper is structured on two chapters and conclusions. It starts with the scope of the preliminary ruling which ensures the cooperation between the Court of Justice of EU and national courts regarding a non-litigation procedure, without parties ' initiative and according to which they are invited only to be heard. The Chapter I, called "Procedure of the request for preliminary ruling before the Court of Justice of the European Union" treats the nature of this procedure, including the initiative of submitting such a request and the incidental character of this procedure. In Chapter II,, Interference between preliminary request and other actions submitted to the Court of Justice of the European Union" is the topic to be analyzed. Thus, the request for preliminary rulings and the way the states are notified about not fulfilling their obligations provided by the Treaties of EU. A comparison between the request for preliminary rulings and the annulment action is also performed. The conclusions reiterate the importance of the mechanism for request for preliminary rulings-a true source of growing for the Union Law.
