Social-legal Dimension of Migration from the Transnational Perspective. A New Look towards International Migration in Cuba

This paper presents an analysis of the international migration from the prism that its study provides from the transnational perspective and its relationship with the socio-legal dimension of this phenomenon. That is why, international migration is explained through the links that the migrant maintains and establishes in both, his and her country of origin and host country, a feature that provides the foundations that explain the transnational perspective of migration. It is an approach that intends to shed the classic methodological nationalism, to define variables that surround the international migration phenomenon, which compels to reassess the socio-legal dimension of migration, starting from the eminent nationalist character of legal norms, as well as concepts and categories that revolve around the law as a norm and the migrant as a subject. The abovementioned is also analyzed observing the particularities and the incidence that international migration shows in Cuba and the challenges that it prints in the incidence of relations seen from the socio-legal dimension of the phenomenon.
