PREVENTION: SOCIAL AND CRIMINAL RESPONSIBILITY OF CORPORATIONS

This paper highlights the relationships between corporate social responsibility (CSR) and criminal law and how the latter plays the role of an instrument in order to raise awareness and stimulate practices of "do responsibly" within companies. Criminal law thus becomes a regulation of "pressure" to establish good business practices, in which the legal person becomes an active subject of crimes on the one hand and on the other is exempted (or attenuated his responsibility) if he has implemented models of organization and management that accredit the good doing responsible constituting the regulation of the "prize". However, in the last part of the work it is analyzed whether the criminal responsibility of corporation turns out to be the ideal instrument to give legal coverage to corporate social responsibility and establish responsible ethics through linguistic arguments.
