ADMISSIBILITY PROBLEMS OF THE EVIDENCE OBTAINED FROM DIGITAL STORAGE DEVICES

In the course of a criminal investigation, the characteristics of the digital data could generate problems both in the acquisition and in the evidentiary assessment of such data. Regarding the identification and acquisition of these kind of evidences by the police, we will focus in the access to the content of the digital storage devices belonging to the person under criminal investigation. In this way, we will highlight those questions that could affect the admissibility of the evidentiary activity displayed.
