摘要：

财政资助研发项目合同是政府为了履行科技行政职能而与项目承担单位就有关研发事项达成的行政协议。企业直接或间接参与财政资助研发项目合作的形式多样化,导致该类项目法律关系和知识产权归属的复杂化。一般而言,依据企业是项目受委托方、实质参与方,或是资金资助方,项目研发成果的知识产权归属有所不同。因此,在制度设计层面,国家有必要进一步完善财政资助研发项目的知识产权政策,以明晰合作企业参与下的财政资助研发项目的知识产权归属,促进政、产、学、研紧密结合。
