英国大学法人制度确立的历史过程及其当代困境:剑桥大学的案例

摘要：
与一般大学不同的是,剑桥大学在成立时既没有创始特许状,也没有创始人,最初是根据习惯法中的风俗或时效而成立的。从建校早期开始,剑桥大学就运用了法人的所有权利,但一直到1571年的《牛津剑桥大学法》,剑桥大学才被正式的法人化。但是,由于英国的法律体系并不严格区分公法人和私法人,同时剑桥大学等英国大学又依赖政府的拨款资助,因此一定程度面临着"国立化"困境,其办学自主权也面临一定的挑战。
