数字身份民法定位的理论与实践:以中国—东盟国家为中心

摘要：

数字身份的民法定位经历了非人格者到人格者、从准人格者到完全人格者的转变。数字身份与真实身份存在紧密联系,两者的连接与疏离折射出数字身份的不同民法定位,数字身份与实体连接越紧密就越表现为客体的民法定位,两者越疏离就越表现为准人格甚至完全人格(法律主体)的民法定位。数字身份拟人化议题属于立法层次而非一种单纯的法律适用层面的问题,就中国—东盟各国现行状况来看,由于赋予数字身份法律人格地位的环境即可信网络空间尚未建立,为此,仍应采取否认数字身份的法律人格为宜,精准揭示与解释数字身份,将其法律意义与精髓导入现行法律框架,运用相关既有法律制度及其修改回应数字身份带来的法律难题。
