从欧盟国家扣留过境仿制药品看过境货物的知识产权保护

摘要：

依据欧盟的1383/03条例,近年来欧盟国家频繁扣留过境的仿制药品。欧盟的1383/03条例违反了TRIPS协议的基本精神,损害了巴黎公约确立的专利独立原则,违反了WTO确立的过境自由原则,给国际贸易带来不确定性,阻碍了仿制药品贸易,影响了发展中国家关键药品的可及性,进而对发展中国家的公共健康造成不利影响。我国作为仿制药品生产大国,应当积极与发展中国家团结协作,充分利用WTO争端解决机制,争取更大的制度空间,利用现有国际条约来限制对知识产权给予更高标准的保护,还应当尽量避免过境欧盟,积极学习欧盟法律以避免不必要的损失。
