世界贸易组织协商一致决策机制的问题与改革

摘要：
作为WTO正式决策机制的核心——协商一致原则自GATT以来就发挥着举足轻重的作用。进入21世纪以来,随着WTO成员国利益分歧的扩大及成员数量的增多,协商一致原则在实际运行中表现出越来越多的不足。效率低下与缺乏正当性是其突出表现。有鉴于此,有的学者认为应该废除协商一致原则或者是对其进行改革。笔者认为,协商一致不能废除,其仍有存在之价值,只是其在运行中所存在的问题,应该通过以"积极协商一致"修正的模式得以改正。
