THE COMMISSION FOR THE GUARANTEE OF THE RIGHT OF ACCESS TO PUBLIC INFORMATION (GAIP) AND THE LIMITATIONS OF ITS INSTITUTIONAL DESIGN

Ten years after the adoption of Catalan Law 19/2014, of 29 December, on transparency, access to public information and good governance (Llei de transpar & egrave;ncia, acc & eacute;s a la informaci & oacute; p & uacute;blica i bon govern), we take stock of what this regulation has represented for the institutionalisation of the Commission for the Guarantee of the Right of Access to Public Information (Comissi & oacute; de Garantia del Dret dA'cc & eacute;s a la Informaci & oacute; P & uacute;blica or GAIP) and of how its design has affected the development of this body whose purpose is to ensure the right of access to information and resolve any claims with full organic and functional independence. Initially we therefore describe the composition of this body based on its regulation in the European sphere and the diversity of models, then examine the current situation in detail and indicate the need for both human and financial resources, and set out the weak points that should be reviewed.
