Weaknesses or Legal-Philosophical Inconsistencies in Luigi Ferrajoli's Proposal of a Constitution for the Earth

This paper aims to analyze Luigi Ferrajoli's project of a Constitution for the Earth and compare it with his legal theory that he has been developing since the beginning of his academic life. The conclusion is that this theoretical perspective is not functional to the ambitious project and is projected onto it, weakening it. However, there is a second conclusion, which is to understand that the proposal reckons on a new Ferrajolian theory that holds a conceptual apparatus that was not present in the one we knew from the Italian professor.
