The purpose of disclaimers with the principle of disclaimer interpretation contra proferentum, are presented. A disclaimer is meant to delineate the scope of rights and obligations arising from an opinion such as rendered in a report. The most common disclaimer for litigation reports is to limit the use of the report to counsel and/or the party who has retained the expert for court use only, not to be relied upon for a future project or other party in the litigation or the public at large. The inspection and report are not intended nor are to be used as a guarantee or warranty, expressed or implied, regarding the future adequacy, performance or condition of any inspected structure, item or system. The inspection should not be considered a technically exhaustive inspection or an insurance policy against unexpected house repair/replacement needs.
