This article is the result of research on the topic of identity theft, which was raised as an objective; analyze the existing data protection mechanisms in Colombia, vis-& agrave;-vis telecommunications companies and their consequent duties to avoid cases of identity theft in natural persons and at the same time evaluate the effectiveness of the existing laws, investigate whether or not they are sufficient to protect to the natural person who is the victim of identity theft, with a consequence for his or her good name, such as the negative report in risk centers as his or her identity has not been effectively verified. This research uses the hermeneutic legal method and is moving towards the qualitative method of Habermas, which Hern & aacute;ndez explains (et.all 2018) Qualitative research is interpretive since it aims to find meaning in phenomena and facts based on the meanings that people give them. Not only objective events are recorded.
