THE REQUIRED PUBLIC LAW OF PUBLIC PROPERTIES, CONTRACTS, EMPLOYMENT AND AGENCIES

The necessary specificity of the public law in contrast to private law becomes evident in the regulation of all the activity of public entities. That is checked here firstly regarding the public properties and the rules of the full real rights of the public Powers, showing their radical distinction with the private property; secondly in relation to the public contracts, insofar as, in contracting, public authorities exercise a public power of allocation of public opportunities and advantages; then with regard to the rules for the civil servants; and finally in relation to the limits of the capacity of public authorities to shape the legal rules of government agencies.
