SOME CRIMINAL LAW AND CRIMINOLOGICAL CHARACTERISTICS OF INFRINGEMENT ON THE CASPIAN BIO-RESOURCES

The paper examines the criminal law, legal, criminological and psychological aspects of poaching. It gives a detailed description of the concept, types, goals and motives of poaching. The key reasons for the increase in poaching are considered to be the following: substantial deterioration of joint efforts by law enforcement and nature protection agencies to prevent, suppress and detect illegal fishing in recent years; inadequacy of special governmental management agencies responsible for this sphere; their inefficient work; inconsistency in the implementation of the legally stated principle of separating the control-supervision and the economic-management functions in this sphere; poor information support of activities aimed at stopping illegal fishing; insufficient material and financial provision of control and inspection agencies; poor legal and social protection of inspectors in nature protection agencies; lack of an efficient mechanism which would allow the community to participate in fighting poaching. The authors come to the conclusion that the government pays insufficient attention to fighting environmental crimes.
