摘要：

The performance of the regulatory function, constitutionally oriented, is one of the most fascinating and complex topics of contemporary constitutionalism. Undoubtedly, the recent economic-financial and environmental crises have only shown the importance of a measure of state intervention in the market arena to induce sustainable development. In this article, the conditions are presented for a regulation compatible with the Constitution, especially to correct market failures and government failures.
