摘要
This article deals with to the power of policy and the eminent domain as techniques of intervention in the pre-constitutional State. Initially, the private law is distinguished from administrative law ahead of a historical perspective. It is discoursed concerning the absolute power concentration, at the hands of the prince, of the policy power and the birth of the modern State. One approaches on the absolute State and its technique of intervention in the private legal sphere. One mentions concerning the doctrine of the treasure and its conceptions in the Roman law and the modern doctrine. Interpretations of some authors concerning the doctrine of the treasure are cited. Finally, reasons of the inexacting of the doctrine of the treasure are pointed according to modern doctrine.
